The foreigner, persecuted in his/her own country, has the possibility to ask Italy for international protection and, therefore, to be recognized as a refugee or to be given other forms of protection (humanitarian or subsidiary protection).
Legal support, provided by legal providers, consists in organizing the beneficiary’s personal dossier and in supporting him/her, together with the cultural mediator, to prepare the interview for Commission. They are fundamental also to manage relations with institutions and to fulfil bureaucratic paperwork. Legal providers in Progetto Itaca have legal expertise regarding the procedure of application, the rights and duties of asylum seekers and the Italian and European laws on this issue. They cooperate with legal aid lawyers and with local Prefecture; they inform asylum seekers about all the possible answers Commission and then court may give, they illustrate guests the opportunity of voluntary return assisted and they support, since 2006, migrants who may adhere to relocation program.
Finally, given the high rate of negative answers from Commission, Progetto Itaca has optimized the cooperation with a pool of lawyers to recommend them to our guests. The advice is obviously free and not-binding. All this to prepare the appeal (a document that gives our guests the possibility to remain in reception facilities) or the second appeal, in order to be given the possibility to remain in Italy after being out of the reception project.
